Lately, I have been receiving many requests for Loan Signings in other states such as Florida, Montana, and Utah. My clients are purchasing properties in other states due to investment profitability.

These types of real estate transactions are extremely important and often time sensitive. From a notary perspective one has to keep in mind that there are different notary laws and Loan compliancy from state to state. For example, when placing someone under oath a notary in California can only use a California Jurat regardless if the notary certificate is provided by the lender or title company. Having a notary and loan signing agent who is well-versed in notary law and loan documents is key.

Loan documents whether buying, selling, or refinancing require meticulousness attention. A signature, initials missed, or a blurry too light or too dark notary seal on loan documents can be a grave problem. Lenders must verify that every paper is correct before they can release funds. Some other important details pertaining to errors on loan documents are:

• the signer signs their name differently than printed on the generated signature line,
• incorrect or unclear dates and dating of the documents.

Often the notary will have to print the loan documents. Having a notary that is experienced is again key here. Loan documents often can go from letter to legal paper when printing. It is important to have the tools of the trade in order to print per the title and or lender’s instructions. Also, attention to detail is very important. Checking to see that the documents did not cut off when printing cannot be stressed enough.
